  • Breaching Solicitors (Scotland) Accounts Rules
  • Breaching HMRC VAT Regulations
  • Incompetence, professional misconduct, and negligence
  • Abuse of his position as an officer of the court
  • Abusing the court process
  • Wilful imposition

Michael Simpson of Tods Murray LLP. (now retired) of:

  • Fee mongering and gross overcharging
  • Misleading (lying to) his client and the court
  • Falsely claiming to be an expert in building disputes
  • Incompetence, professional misconduct, and negligence
  • Breaching the Solicitors Code of Conduct
  • Abusing his position as an officer of the court
  • Abusing the court process
  • Wilful imposition
Tods Murray LLP. of:
  • Failing to adequately supervise the actions of their own partners
  • Failing to prevent their partners from pursuing claims they know to be unjustified (they do have an accounts department)
  • Wilful imposition

 

Simpson & Marwick LLP. of:

  • Abusing their position as officers of the court
  • Abusing the court process
  • Breaching the Solicitors Code of Conduct
  • Misleading (lying to) the court and their counsel
  • Aiding and abetting wilful imposition
Peter Anderson of Simpson & Marwick LLP. of:
  • Abusing his position as an officer of the court
  • Lodging a summons his client drafted and failing to verify its contents were true and accurate
  • Applying punitive diligence when he had no proper foundation for doing so
  • Abusing the court process
  • Aiding and abetting wilful imposition
William  Macreath of Levy & McRae Solicitors and Notaries Public of:
  • Failing to act in his client’s interests
  • Failing to lodge competent defences
  • NB.  A Law Society Reporter has recently accused William Macreath of five counts of inadequate service and seven counts of professional misconduct.  See http://petercherbi.blogspot.co.uk/  for the details.  I could help the Law Society add to that list.
The Law Society of Scotland’s Mr. Philip Yelland of:
  • Failing to properly regulate Scotland’s solicitors
  • Failing to protect the interests of the consumer
  • Misleading (lying to) complainants
  • Failing to prevent dubious legal techniques being used to halt his Society’s investigations of solicitors
  • Effectively aiding and abetting wilful imposition
The Scottish Legal Complaints Commission of:
  • Failing to properly regulate Scotland’s solicitors
  • Failing to protect the interest of the consumer
  • Failing to prevent dubious legal techniques being used to prevent their organisation from investigating solicitors
  • Effectively aiding and abetting wilful imposition
This list is not exhaustive and will be added to in due course.  These accusations, which I have kept to a bare minimum for the time being, can all be proved by the documentation contained on this site.

Vacancies

Part-time preparation solicitor required. Must have experience of civil litigation in the Court of Session. Hourly rate will be agreed in advance and must be adhered to by the solicitor. All outlays reasonably incurred must be supported by receipts, be included on any invoices rendered by the solicitor to us, and must show the VAT on outlays separately from the VAT on fees charged.

All invoices must be rendered by the solicitor no later than 3 months from the time of supply. We will make payment within 30 days of any VAT invoices that are rendered. Once paid, the invoice amount will not be increased by the solicitor at a later date.
